After a little investigan O Shea was identified by the taxcollector and summoned to appear before the judge in the Assizes for trial. O Shea knowing the consequences asked Daniel O Connell for advice. The Assizes judge was coming to Daniel's residence the day before the court, so he told O Shea to send out mesages that he was dead.
O Shea followed his advice and a crowd gathered outside his cottage door on the day mentioned. Daniel and the judge went for a walk and happened to take the road towards O Connell explained the cause to the justice.
